Terms of Use

Amplistay · RENTATOP TECH, S.L.

These Terms of Use (the "Terms") apply both to anyone who registers an account with Amplistay to manage their accommodation (a "Host") and to anyone who books, pays, extends a stay, signs a contract, fills in their traveller registration or otherwise uses a Host's website, booking page or "Your stay" page (a "Guest") - we refer to both as "User" wherever a clause applies equally. By registering as a Host, or by using any of those pages as a Guest, you agree to comply with and be bound by these Terms.

If you are a Guest: your accommodation relationship - dates, price, house rules, contract, cancellations - is with the Host, not with Amplistay, as explained further below. Amplistay's role is limited to providing the technology: the website, the page where you book, pay or extend your stay, and the "Your stay" page with the guide, the contract and the traveller registration; it does not vet the Host or provide the accommodation itself. How we handle your personal data is explained in our Privacy Policy.

1. Service Description Amplistay is a Software as a Service (SaaS) platform that offers vacation rental Hosts, under a single subscription, the following features:

  • Booking page: A technological interface for charging direct bookings and stay extensions (early check-in, late check-out, extra nights) through third-party payment processors.
  • Website: Hosting of the Host's site, on an Amplistay subdomain or on the Host's own domain.
  • Booking management: Calendar synchronization with other platforms (iCal) and a record of every channel's bookings in the Host's dashboard.
  • Stay management: For each booking, a "Your stay" page with the accommodation's guide, a contract the Guest signs online and the registration of everyone staying; in Spain, the option for the Host to send that registration to SES Hospedajes.

Amplistay is not a party to any transaction, rental agreement, or service contract established between a Host and their Guest. Our role is strictly limited to providing the technological infrastructure to facilitate these operations. Amplistay is not a travel agency or a real estate broker.

2. Business Certification and Regulatory Compliance

  • Self-Declaration: By using the Platform to process payments or manage properties, the Host warrants that they comply with all local, regional, and national regulations, including the possession of required tourist licenses and tax registrations, and any traveller registration obligations that apply to them.
  • Traveller registration and SES Hospedajes: Reporting travellers to the authorities is the Host's obligation. Amplistay never sends those reports on its own: a submission to SES Hospedajes only happens when the Host triggers it from their dashboard, with their own credentials, and the Host is solely responsible for doing so on time and with correct data.
  • Contracts: The content of the contract the Guest signs is decided by the Host. Amplistay does not review or guarantee its legal validity.
  • Indemnification: The Host is solely responsible for their legal and fiscal compliance. Amplistay does not verify the existence of licenses. The Host agrees to hold Amplistay harmless from any legal action, fine, or penalty arising from regulatory non-compliance.

3. Technological Intermediation and Payments

  • Nature of the booking page: The booking page is a link meant to be shared directly by the Host with their own guests (via WhatsApp, email, social media, or from their own website). Amplistay does not operate a search engine or public directory where Guests can discover or compare properties across different Hosts.
  • Payment processors: Guests are charged through Stripe (Stripe Connect, on the Host's own account) or through the payment gateway of the Host's bank (Redsys). The money goes directly to the Host.
  • No Amplistay commission: Amplistay charges no commission on Guests' payments. The payment processor applies its own fees, governed by the agreement between the Host and that processor.

4. Subscription, Hosting and Domains

  • Free use without publishing: Creating an account and setting up and previewing every feature is free, with no time limit. As long as there is no active subscription, nothing that has been set up is accessible to Guests.
  • Subscription: Switching the features on for Guests - the website, the booking page, extensions and the "Your stay" page - requires an active subscription of $19/month (€19/month for accounts billed in euros), taxes included, per website, plus $9/month (€9/month for accounts billed in euros), taxes included, for each additional unit (sub-property) on that website. It is billed through Stripe and renews monthly until cancelled.
  • Free or promotional periods: Amplistay may grant the subscription free of charge or at a discount for a set period. When that period ends, if the Host has not subscribed, the same applies as on cancellation.
  • Cancellation: The subscription can be cancelled at any time, with no commitment. Once the period already paid for ends, the website, the booking page, extensions and the "Your stay" page are no longer accessible to Guests. No content in the account is deleted: it becomes available again upon subscribing again.
  • Domains: With the subscription, the Host can connect a custom domain. Ownership, registration, and renewal of any custom domain is the Host's sole responsibility.
  • Legal notice: Amplistay generates the legal notice for the Host's site from the fiscal details the Host enters. It is the Host's sole responsibility to ensure those details are accurate and complete, and to review and adapt the legal notice to their own business, location, and applicable regulations before publishing their site.
  • Published content: The Host is solely responsible for the content of their website, guide and contract: descriptions, photographs, prices, booking conditions and clauses.

5. Guests' Data

  • The data a Guest provides when booking, signing the contract or in the traveller registration is collected on behalf of the Host, who is the controller of that data. Amplistay acts as a processor: it processes that data solely to provide the service to the Host, following their instructions, with appropriate security measures (document numbers are stored encrypted), and never for its own purposes.
  • Traveller registration data is sent to the Host as a PDF and deleted from the Platform 30 days after that copy is sent (or, if it is never sent, 60 days after check-out). The Host is responsible for keeping it for as long as the law requires of them.
  • Amplistay may use the sub-processors listed in the Privacy Policy to provide the service.

6. Operational Responsibility Disclaimer

  • Data Accuracy: It is the User's sole responsibility to verify that booking dates, amounts, and metadata are correctly configured. Amplistay is not liable for operational failures resulting from incorrect user input or delays from third-party APIs, including calendar synchronization with other platforms.
  • Service Fulfillment: Once a payment is processed, the technological service is considered rendered. Amplistay is not responsible for disputes regarding the quality of the stay or the relationship between the Host and the Guest.

7. Accounts and Billing

  • Account Registration: The person creating the account warrants they have the authority to legally bind the Host to Amplistay.
  • Billing: The subscription is charged through Stripe. By subscribing, the Host authorizes the monthly subscription charge. If they charge their Guests through Stripe, they also agree to the Stripe Connected Account Agreement.

8. Intellectual Property

  • Our Property: All content, software, and technology on the Platform are the exclusive property of Amplistay.
  • Your Data: You retain ownership of the information you upload, including your page's content. You grant us a limited license to process, store, and publish said content solely to provide the service.

9. Disclaimer and Limitation of Liability

  • The Platform is provided "as is" and "as available." Amplistay is not responsible for disputes, losses, damages, or fines arising from the use of our payment, website hosting or stay management tools, or from the relationship between a Host and a Guest.
  • Our total liability for any claims shall be limited to the amount of subscription charges collected by Amplistay from the user in the three (3) months preceding the claim.

10. Governing Law and Jurisdiction These Terms shall be governed by the laws of Spain. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Madrid, Spain.
