By registering, accessing, or using our software platform (hereinafter, the "Platform"), you agree to comply with and be bound by the following terms and conditions (hereinafter, the "Terms").

1. Service Description Amplistay is a specialized Software as a Service (SaaS) platform designed to provide technological payment infrastructure and management tools for property managers and owners. Our services include:

• Payment Infrastructure: Providing a specialized technological interface for processing secure payments through third-party processors.
• Stay Management Tools: Systems for managing check-in/out extensions and stay-related add-ons.
• Automated Logistics: Tools for the automated creation of internal records and booking synchronization for operational efficiency.

Amplistay is not a party to any transaction, rental agreement, or service contract established between a Business (hereinafter, "Provider") and their Guest. Our role is strictly limited to providing the technological infrastructure to facilitate these operations. Amplistay is not a travel agency, real estate broker, or a public tourist offer channel.

2. Business Certification and Regulatory Compliance

• Self-Declaration: By using the Platform to process payments or manage properties, the Provider warrants that they comply with all local, regional, and national regulations, including the possession of required tourist licenses and tax registrations.
• Indemnification: The Provider is solely responsible for their legal and fiscal compliance. Amplistay does not verify the existence of licenses. The Provider agrees to hold Amplistay harmless from any legal action, fine, or penalty arising from regulatory non-compliance.

3. Technological Intermediation and Payments

• Nature of Links: Amplistay provides private technological links to be used by the Provider with their pre-existing clients. The Platform does not publicly market or list properties to the general public.
• Fees: Amplistay charges a 3% technological service fee for each transaction processed. This fee is for the use of the software and is automatically deducted at the time of the transaction via Stripe Connect.

4. Operational Responsibility Disclaimer

• Data Accuracy: It is the User's sole responsibility to verify that booking dates, amounts, and metadata are correctly configured. Amplistay is not liable for operational failures resulting from incorrect user input or synchronization delays from third-party APIs.
• Service Fulfillment: Once a payment is processed, the technological service is considered rendered. Amplistay is not responsible for disputes regarding the quality of the stay or guest-owner relationships.

5. Accounts and Payments

• Business Registration: The person creating the account warrants they have the authority to legally bind the Business to Amplistay.
• Billing: All payments are processed through Stripe. By using the service, you authorize the charge of the selected fees and agree to the Stripe Connected Account Agreement.

6. Intellectual Property

• Our Property: All content, software, and technology on the Platform are the exclusive property of Amplistay.
• Your Data: You retain ownership of the information you upload. You grant us a limited license to process and store said content solely to provide the service.

7. Disclaimer and Limitation of Liability

• The Platform is provided "as is" and "as available." Amplistay is not responsible for disputes, losses, damages, or fines arising from the use of our payment tools or the relationship between a Provider and a Guest.
• Our total liability for any claims shall be limited to the amount of service fees collected by Amplistay from the user in the three (3) months preceding the claim.

8. Governing Law and Jurisdiction These Terms shall be governed by the laws of Spain. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Madrid, Spain.
